For those foreigners who intend to get married in Thailand, the process would start from your respective embassy. An Affirmation of Freedom to marry, as most commonly known by many, or a Statutory Declaration, or an Affidavit must be obtained from the embassy. Certified copies of your passports shall be done as well. Most likely the process will be done within the time of your visit, though other embassies may take few days.
It is best to check with the embassy prior to your visit in order to make an appointment if required, and bring the required documents needed by your embassy for the issuance of the paperwork for marriage in Thailand. In case the applicant is a divorced individual or widowed, additional documents will be asked such as divorce or death certificate presented on the date of your visit to the embassies.
Once documents obtained the from your embassies, the next step will follow smoothly. Most embassies issue documents in English language, which has to be translated to Thai by a certified translator. Once translated, it must go through legalization process which will be submitted for evaluation at the Thai Ministry of Foreign Affairs (MFA). It takes at least 2-3 working days for the legalization process. For certain nationalities, an interview maybe required as deemed necessary before document issuance.
Once documents stamped by the MFA you may now proceed to any of the local District Offices in Thailand for the marriage registration. The District offices are normally known as the “Amphur”, this is the place wherein marriage registration shall be performed by the district officer. It is very important to have a translator at the time of marriage, and also you will be required to bring with you witnesses. On the day of registration, your Thai marriage documents will be signed by you and your spouse, the witnesses and the district officer.
